By using 1coach.by service, you agree to comply with and be bound by the following Terms and Conditions governing the relationship between you and Mr. Vitali Churak, the owner of the 1coach.by products and website(s). If you do not agree to these Terms and Conditions, please do not use the 1coach.by website and its Services.

Relationship

Using Coachbot’s services and website(s) (from now on referred to as the “Services”) is subject to the Terms of a contractual agreement between you, Mrs. Maria Churak (Certified Coach as accredited by the International Coach Union who leads the executive coaching group within 1coach.by) and Mr. Vitali Churak (from now on referred to as the “Product Owner”), located at Minsk, Belarus.

“You” or “your” means the individual using Coachbot. “Coachbot” means the Coachbot's web-page on Facebook, 1coach.by website and Services provided on the site, virtual classroom in Jitsi, chatbot in Facebook Messenger, chatbot Telegram, Slack team. These Terms explain how the agreement is made and sets out some of the Terms of that agreement.

Provision of the Services

To provide the best possible user experience, 1coach.by may change or improve its Services. You understand and agree that changes to the Services may occur without prior notice. 1coach.by may stop providing the Service to you without prior notice. You may stop using the Coachbot at any time without prior notice to Product Owner.

Limitation of liability

In no event shall Product Owner be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages including lost profit damages arising from your use of Coachbot. Coachbot provides services as it is and do not accept any liability for that.

Your use of the Services

1coach.by might ask for information about you to access certain Services. All of the information you provide to 1coach.by should always be correct and up to date.

You agree that you:

a) Will never access (or attempt to access) any of the Services by any means other than through the interface provided by 1coach.by;

b) Will not do anything to interfere with or disrupt the Services;

c) Alone are solely responsible for any breach of your obligations under the Terms and the consequences of any such breach. 1coach.by has no responsibility to you or any third party.

d) Alone and solely responsible for the content of your 1coach.by coach sessions and chatbot. Product owner does not accept liability for the offensive language used in 1coach.by coach sessions or chatbot.

Content in the Services

Product Owner has the right to review, flag, filter, modify, refuse or remove any or all content that you have created on Coachbot's Services.

By agreeing to these terms, you understand that the use of the Services is fully at your risk. You may be exposed to content that you may find offensive. Product Owner can not be held responsible if you are exposed to such content. You agree that you are responsible for all the content you create and display. Product Owner can not be held responsible for any of the content you create or lose in this process.

Proprietary rights and License

You acknowledge and agree that Product Owner owns all legal right, title, logo in and to the Services including any intellectual property rights that subsist in the current Services. You agree and acknowledge that you may not copy, modify or otherwise extract the source code of 1coach.by.

Dissolution of the agreements

These Terms will continue to apply until terminated by either you or Product Owner. You can terminate the contractual agreement by closing your account for Coachbot's DokuWiki website.

1coach.by may terminate its contractual agreement with you if:

a) You have breached any of the agreed terms written in these Terms; or

b) Product Owner is ordered to do so by law; or

c) 1coach.by is no longer providing the Services to users.

Exclusions

You agree that the Services are provided “as-is” and “as available”.

1coach.by, its affiliates and licensors do not represent or warrant to you that:

a) The use of Coachbot’s Services will meet your requirements;

b) The use of the services will be uninterrupted without any errors;

c) Any defects in the functionality of the Services will be corrected.

Obtaining material through the use of the Services is done at your risk. You are responsible for every action you perform on 1coach.by and its consequences.

Product Owner cannot be held responsible for your actions and their consequences.

Modification of the Terms and Conditions

Product Owner may make changes to the Terms and Conditions from time to time.

Applicable law

Any disputes arising out of or related to these Terms and Conditions and any use by you of the Services shall be governed by the laws of Republic of Belarus, without regard to the conflicts of laws provisions therein.
